2024 CivicPlus® Civic Experience Awards Program

  1. GOAL. The goal of the 2024 CivicPlus Civic Experience Awards Program (the “Contest”) is to recognize and honor government departments or teams that are improving civic experiences in their communities. As part of this effort, CivicPlus, LLC (referred to herein as “CivicPlus” or “Sponsor”) is sponsoring the Contest in which existing CivicPlus customers (or their designee) from any U.S. locality can nominate any local, state, and federal government leader using the dedicated microsite form. The submission must describe how the nominee used an initiative, or efforts, to improve the civic experience in their community.
  2. ELIGIBILITY. The Contest is open only to all local, state, and federal government departments, teams, and current CivicPlus customers in a United States locality (the “Contestant”), who are nominated by a government employee, or self-nominate, by entering a submission at the dedicated microsite: civicplus.com/civicexperienceawards. The Contest is only open to Contestants who are at least 21 years of age, legal residents of the United States, and an authorized government employee. Employees of CivicPlus, their respective affiliates, subsidiaries, advertising and promotion agencies, suppliers and their immediate family members and/or those living in the same household of each are not eligible to participate in the Contest. The Contest is subject to all applicable federal, state and local laws and regulations. Void where prohibited by law. All winners shall sign and return to CivicPlus an Affidavit of Eligibility attesting to their eligibility as required herein and a 1099 form. CivicPlus’ determination of eligibility, in its sole discretion, is final.
  3. AGREEMENT TO RULES. By participating, Contestants are agreeing to be fully unconditionally bound by these terms and conditions and represent and warrant that they meet the eligibility requirements set forth herein. In addition, by participating, Contestants agree to accept the decisions of CivicPlus, as final and binding as it relates to the content. The Contest is subject to all applicable federal, state, and local laws.
  4. PROMOTIONAL PERIOD. Entries will be accepted online starting on or about May 13, 2024, and ending July 1, 2024 (the “Promotional Period”). All entries must be received by July 1, 2024, 11:59 p.m. PST.
  5. HOW TO ENTER. During the Promotion Period, the Contestants will use the online submission form found at civicplus.com/civic-experience-awards, and follow the instructions provided to complete and submit a registration form to receive one (1) entry (“Entry”) into the Contest. Submitting an Entry constitutes Contestant’s consent to participate in the Contest and consent for Sponsor and the Contest Administrator to obtain, use, and transfer their name, address, email and other details for Contest administrative purposes. Entries must be submitted electronically through the online form. No other methods of entry shall be accepted. Except as noted in these terms and conditions, information collected for the Contest is used only for the purposes of Contest administration and winner notification, and will not be re-used, sold or shared in any manner by the Sponsor, Administrator or any third parties, unless Contestant has elected to receive additional information and Contest materials from the Sponsor or any third party. By participating in the Contest, Contestant agrees to all the terms and conditions of the Sponsor’s privacy policy, which is available at https://www.civicplus.com/privacy-policy. In the event of any discrepancy between the Sponsor’s privacy policy and these terms and conditions, these terms and conditions shall control and govern.
  6. SUBMISSION CRITERIA. Entries must be original in content; in the English language; submitted using the online submission form; and specifically written for the Contest. All entries are final, no revisions shall be accepted.
  7. ENTRY LIMIT. The Contest must be entered by submitting an entry using the online form provided on the Contest site. The entry must fulfill all Contest requirements, as specified, to be eligible to win a prize. Entries that are not complete or do not adhere to the rules or specifications may be disqualified at the sole discretion of CivicPlus. Contestants must fill in the information requested. If Contestants use fraudulent methods or otherwise attempt to circumvent the rules their submission may be removed from eligibility at the sole discretion of CivicPlus. Proper submission of all required forms constitutes acceptance of all conditions set forth in these rules.
  8. JUDGING. Ten sub-finalists shall be selected by a panel of CivicPlus employees. CivicPlus shall use a panel comprised of CivicPlus employees, the finalists from previous Civic Experience Awards, and CivicPlus Partners, (“Administrator” or “Judges”) to select three finalists (“Finalists”), whom will be announced on or about August 1, 2024, by CivicPlus. One Finalist will be identified as the winner (“the “Winner”) through a press release on or about October 14, 2024. The decision of the Judges is final. Entries will be judged based on the submission’s ability to convey the degree to which a Contestant’s actions or initiatives have made a significant, lasting impact on the civic experience in their community by producing quantifiable results by improving: interactions with residents; methods of saving time and money; staff efficiency and job satisfaction; and employee and resident engagement. CivicPlus reserves the right not to award any prize(s) if, in CivicPlus’ sole judgment (based upon the Judge’s recommendation), the quality of submitted entries does not merit award(s).
  9. PRIZES. The Winner shall receive a first-place trophy or plaque; and a charitable contribution to an initiative or non-profit entity, in the Winner’s community, from CivicPlus for the amount of $1,500.00. If the actual prize value is lower than the stated approximate value, the difference shall not be awarded. The second-place finalist shall receive a second-place trophy or plaque and a charitable contribution to an initiative or non-profit entity, in their community, from CivicPlus for the amount of $500.00. The third-place finalist shall receive a third-place trophy or plaque and a charitable contribution to an initiative or non-profit entity, in their community, from CivicPlus for the amount of $500.00. Actual/appraised value may differ at time of prize award. The specifics of the prize shall be solely determined by the Sponsor. No cash or other prize substitute permitted except at Sponsor’s discretion. The prize is non-transferable. Winner must submit a completed W-9 to receive their free registration. The full fair market value of the prize will be reported on a 1099. Any and all prize-related expenses, including without limitation any and all federal, state, and/or local taxes shall be the sole responsibility of the winner. No substitute of prize or transfer/assignment of prize to others or request for the cash equivalent by winners is permitted. Acceptance of prize constitutes permission for CivicPlus to use the winning Contestant’s name, likeness, and entry for purposes of advertising and trade without further compensation, unless prohibited by law. The Winner, second-place finalist, and third-place finalist will be required to participate in a video recording to showcase their submission, at a mutually agreed upon time and location, to be used for promotional purposes. By accepting the prize, each agrees to appear in the video recording and grants CivicPlus the right to use their image and likeness in promotional materials. Failure to participate in the video recording may result in disqualification and the selection of a new winner. Any and all tie-breakers will be determined by the Judges in their sole discretion.
  10. ODDS. The odds of winning depend on the number of eligible entries received. However, CivicPlus reserves the right not to award any prize if the Judges determine that no entries are sufficient quality to merit selection.
  11. WINNER SELECTION AND NOTIFICATION. The Finalists of the Contest will be selected by a panel of judges. Finalists shall be notified via email to the email address they entered the Contest with within five (5) business days following the winner selection. CivicPlus shall have no liability for a winner’s failure to receive notices due to winners’ spam, junk e-mail or other security settings or for winners’ provision of incorrect or otherwise non-functioning contact information. CivicPlus reserves the right not to award any prizes if it is determined that no entries are of sufficient quality to merit selection. If the selected winner cannot be contacted, is ineligible, fails to claim the prize within 15 days from the time award notification was sent, or fails to timely return a completed and executed declaration and releases as required, prize may be forfeited, and an alternative winner may be selected.
  12. GENERAL TERMS. CivicPlus reserves the right, in its sole discretion to cancel, terminate, modify or suspend the Contest should (in its sole discretion) should the administration, security, fairness or proper conduct of the Contest be affected by any force beyond the control of CivicPlus, including, without limitation, a pandemic, strike, work stoppage or non-authorized human intervention, accidents, acts of war, civil or military disturbance, natural catastrophes or acts of God, fraud, or the loss or malfunction of utilities, communications or computer (software or hardware) services. CivicPlus reserves the right at its sole discretion to disqualify any individual who tampers or attempts to tamper with the entry process or the operation of the Contest or website or violates these terms and conditions. CivicPlus has the right, in its sole discretion, to maintain the integrity of the Contest, to void entries for any reason, including, but not limited to; multiple entries from the same user from different IP addresses; multiple entries from the same computer in excess of that allowed by the Contest rules; or the use of bots, macros or scripts or other technical means for entering.Any attempt by an individual to deliberately damage any web site or undermine the legitimate operation of the Contest may be a violation of criminal and civil laws and should such attempt be made, CivicPlus reserves the right to seek damages from any such person or entity to the fullest extent permitted by law.By entering its content and registering for the Contest, Contestants understand that CivicPlus, anyone acting on behalf of CivicPlus, or its respective licensees, successors and assigns will have the right, where permitted by law, without any further notice, review or consent to reproduce, display, publish, broadcast, distribute, and use, worldwide in any media now know or hereafter in perpetuity and throughout the World, Contestant’s entry, including, without limitation, the entry and winner’s name, image or statements about the Contest, and biographical information as news, publicity or information and for trade, advertising, public relations and promotional purposes without any further compensation. It is the Contestant’s responsibility to ensure the name, likeness, or location of any nominee may be used in the Entry.

    By entering the Contest, Contestants understand and agree that all winners are expected to enter into an agreement with CivicPlus controlling the Prizes awarded herein.

  13. LIMITATION OF LIABILITY; DISCLAIMER OF WARRANTIES. By entering the Contest, each Contestant agrees to release and hold harmless CivicPlus and its subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigned, employees, officers and directors from any liability, illness, injury, death, loss, litigation, claim or damage that may occur, directly or indirectly, whether caused by negligence or not, from (i) such Contestant’s participation in the Contest and/or his/her acceptance, possession, use, or misuse of any prize or portion thereof, (ii) technical failures of any kind, including but not limited to the malfunctioning of any computer, cable, network, hardware or software; (iii) the unavailability or inaccessibility of any transmissions or telephone or internet service; (iv) unauthorized human intervention in any part of the entry process or the Promotion; (v) electronic or human error which may occur in the administration of the Promotion or the processing of entries; and (vi) CivicPlus publishing or displaying the Entry, including the name and location of any individual nominated in the Entry. IN NO EVENT WILL THE RELEASED PARTIES AND/OR THEIR RESPECTIVE PARENT COMPANIES, SUBSIDIARIES, AFFILIATES, PARTNERS, REPRESENTATIVES, AGENTS, SUCCESSORS, ASSIGNS, EMPLOYEES, OFFICERS AND DIRECTORS, BE RESPONSIBLE OR LIABLE FOR ANY DAMAGES OR LOSSES OF ANY KIND, INCLUDING DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING OUT OF THE CONTEST, AND/OR DOWNLOADING FROM AND/OR PRINTING MATERIAL DOWNLOADED FROM ANY WEBSITES ASSOCIATED WITH THE CONTEST. IN NO EVENT SHALL THE RELEASED PARTIES’ TOTAL LIABILITY TO CONTESTANT FOR ALL DAMAGES, LOSSES, OR CAUSES OF ACTION EXCEED FIVE DOLLARS ($5.00 USD). WITHOUT LIMITING THE FOREGOING, THE CONTEST AND PRIZES ARE PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND FROM SPONSOR, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. SOME JURISDICTIONS MAY NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES OR EXCLUSION OF IMPLIED WARRANTIES, SO SOME OF THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO CONTESTANT. CONTESTANTS SHALL CHECK LOCAL LAWS FOR ANY RESTRICTIONS OR LIMITATIONS REGARDING THESE LIMITATIONS OR EXCLUSIONS
  14. DISPUTES. The Contest shall be governed by the laws of the State of Kansas. Each Contestant knowingly and voluntarily intends and agrees that (i) the mandatory, exclusive venue for any action in any way related to or arising out of the Contest shall be resolved individually without resort to any form of class action and shall be the state and federal courts in and for Riley County, Kansas; and (ii) any and all claims, judgements and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the Contest, but in no event attorneys’ fees. Each Contestant hereby knowingly and voluntarily waives any and all objections to venue and personal jurisdiction in the foregoing and submit themselves thereto. Each Contestant hereby waives any right it may have to assert the doctrine of forum non conveniens or similar doctrine or to object to venue with respect to any proceeding brought in accordance with this paragraph and stipulates that the aforementioned courts shall have in personam jurisdiction and venue over them for the purpose of litigating any dispute, controversy, or proceeding arising out of or related to the Contest. Void where prohibited by law.
  15. CLASS ACTION WAIVER. Each party agrees that an arbitrator, judge, magistrate or other similar authority may not consolidate more than one person’s claims and may not otherwise preside over any form of a representative or class proceeding, and that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated or representative action. Contestants agree to waive any right to a jury trial to participate in a class action.
  16. PRIVACY POLICY. Information submitted to Administrator by any Contestant is subject to CivicPlus’ privacy policy located at https://www.civicplus.com/privacy-policy.
  17. WINNERS LIST. The winners’ names may be obtained by sending a properly stamped, self-addressed envelope to CivicPlus, LLC, at 302 S. 4th Street, STE 500, Manhattan, Kansas 66502. Requests must be received no later than October 31, 2024.
  18. SPONSOR AND ADMINISTRATOR. The Contest is sponsored by CivicPlus, LLC, having its principal place of business at 302 S 4th Street, STE 500, Manhattan, Kansas 66502.
